Terms & Conditions

ORDERS
Orders are subject to written acceptance by JB Industries, Inc. home office and are subject to strikes, accidents, delays by suppliers and other causes beyond our control. Receipt of an order will be understood as acceptance of these terms and conditions unless specific agreement to the contrary has been made in writing prior to order placement.

MINIMUMS
A $50.00 minimum charge will apply to all orders excluding transportation. Orders for special parts and/or quantities in response to our quotation are not cancelable without our written permission and then only upon reimbursement for any loss or damage. Orders for special items are subject to shipment of 10% over or under quantity ordered.

PRICES
Prices shown apply to quantities on a single shipment to a single destination and do not include any sales tax that may apply. All prices are subject to change without notice and all shipments will be invoiced at prices in effect at time of shipment.

TERMS
Terms are 1% 15 days, net 30. 1-1/2% per month (18% annum) service charge will apply to past due invoices.

FREIGHT
For orders within the continental U. S., JB will ship prepaid via least expensive way on single orders of $2,500.00 or more. For Alaska and Hawaii, JB will ship F. O. B. port of embarkation via least expensive way on single orders of $2,500.00 or more. For all international orders, JB`s terms are Ex-Works Factory, Aurora, Illinois.

DAMAGES
Damages in transit are the responsibility of the carrier and such claims should be filed with them and not JB, as our responsibility ends upon receipt of the material by the carrier.

SHORTAGES
Claims for shortages must be made within 10 days of delivery.

RETURNS
Returns will not be accepted without written Return Goods Authorization Number (RGA) from home office and must be sent prepaid freight.

LIMITED WARRANTY
Products sold by JB Industries, Inc. are warranted for a period of 12 months from the date of sale with the following exceptions:

Vacuum pumps are warranted 24 months over-the-counter
Digital gauges are warranted 12 months over-the-counter
Rothenberger tools are warranted 24 months over-the-counter

JB limits this warranty to the repair, replacement or credit at invoice price (JB’s option) of products that in JB’s opinion are defective due to defects in workmanship and/or materials. Warranty claims resulting from obvious product abuse, misuse such as broken parts or lack of maintenance including failure to keep the vacuum pump filled with clean oil, abnormal use or normal wear and tear will not be honored as warranty repair and will be subject to JB’s published repair costs. This express warranty is in lieu of and excludes all other warranties, guarantees and/or representations, express or implied, of JB and/or the manufacturer of such products that make NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. Technical information, recommendations and advice as to properties and usages of materials, design, installation and use of products, engineering and other matters are provided as an accommodation and are intended only as suggestions. Although they are believed to be accurate, based on JB’s knowledge and experience, JB assumes no obligation or liability for any results obtained in their use or application, and they are not to be construed as establishing ant warranty, express or implied. In no event shall JB be liable for claims for any damages whatsoever (whether direct, foreseeable, consequential or special) suffered by buyer or anyone else arising out of any breach by JB. JB makes no warranty to those defined as consumers in the Magnuson-Moss Warranty-Federal Trade Commission Improvement Act.

JB vacuum pumps are not intended for use on Amonia or Lithium Bromide (salt water) systems. Use of JB vacuum pumps on either of these systems VOIDS the product warranty.

WARNING
JB Products are designed for use by technically trained Air Conditioning and Refrigeration Service Engineers only. Due to the high pressures encountered in these systems plus the dangers due to the physical and chemical nature of refrigerants and oils present in the systems, misapplication could result in injury or death. JB Industries, Inc. expressly warns against the sale to or use of this product by other than professionally trained personnel.

All product items pictured, described or otherwise displayed or described herein are subject to changes, alterations and or modifications at anytime by JB Industries, Inc.

The prices, terms and conditions for the purchases of JB Industries, Inc. products are subject to changes, alterations and or modifications at anytime by JB Industries, Inc. and will be made available upon request to JB Industries, Inc. and shall be provided to customers of JB Industries, Inc. at time of purchase.

Place of contract and sale is JB Industries, Inc., Aurora, Kane County, IL 60505. Any and all actions, claims, lawsuits, legal complaints or otherwise arising from JB Industries, Inc. products shall rest with the Jurisdiction of the State of Illinois and Venue shall rest in the County of Kane. The Laws of the State of Illinois shall be the law applied in any legal action involving this purchase. If Purchaser fails to comply with the terms and conditions of said sales, Purchaser shall pay JB Industries, Inc.`s reasonable attorneys` fees for the services of JB Industries, Inc.`s attorney in action, including all costs and expenses incurred by JB Industries, Inc.
